Guardianships are often needed when a child’s parents die or when biological parents can no longer take responsibility for the child. What Is a California Legal Guardianship?

When the biological parents can no longer care for a child, the court can establish a legal guardian who will have similar responsibilities to those of a parent. The legal guardian does not necessarily have to be a family member, although they are often the most prevalent. Those who may petition the court for this responsibility may be friends of the family, foster parents, or anyone else who knows the child. Common legal guardians include grandparents, sisters or brothers, aunts or uncles, or other relatives.

The legal guardian is responsible for:

  • Where the child lives
  • Where the child goes to school
  • Healthcare
  • Financial support
  • The child’s general welfare and well-being
  • Any other responsibilities a parent would have
