Family Law Trial Victory for Bremer Whyte Brown & O’Meara Partners

At Bremer Whyte Brown & O’Meara we are elated to announce Founding Partner Nicole Whyte and Partner Nicole Nuzzo's most recent trial victory in a family lawsuit. Ms. Nuzzo's excellent and meticulous briefing, witness litanies, and arguments won the day in court, while Ms. Whyte served as lead counsel at trial.

The client received eight pending requests for order (RFOs) seeking modification of child custody and support in addition to various ancillary orders. Under California law, child custody and support orders can only be modified if the party seeking modification can demonstrate that a material change in circumstances justifies granting their request. Child custody and support modifications require courts to examine a material change in circumstances relevant to the best interests of the parties’ minor child, including the relative financial conditions of the parties.

Following a full day of hearing, which included witness testimony and argument, the court ruled from the bench in favor of our client in all respects. Bremer Whyte Brown & O’Meara would also like to recognize family law associate Jocelyn Russo and law clerks Salani Mathur and Jazlyn Cabula on their invaluable legal work and assistance, leading to a great result.
