Bremer Whyte respects your privacy. This Privacy Policy applies to Bremer
Whyte Brown & O’Meara, LLP (“We”, “Our”, “Us”). This Privacy Policy explains
how we collect, use and share the personal information that we gather on our
websites, www.bremerwhyte.com and www.bremerwhytefamily.com (the “Site”
or “Sites”),when you contact us to obtain more information, or directly through
your use of our online platform and services (“Services”). A reference to
“Bremer Whyte,” “we,” “us,” or the “Company” is a reference to Bremer Whyte
and its relevant affiliates involved in the collection, use, sharing or other
processing of personal information.
This Privacy Policy does not apply to the way Bremer Whyte processes
information on behalf of our clients. Bremer Whyte processes and safeguards all
communications with our clients in accordance with our engagement
agreements and the duties and responsibilities of attorney-client privilege.

1. Whose Personal Information Do We Collect?
Bremer Whyte obtains information from various entities. These entities are
defined below by what they are referred to in this Privacy Policy and when
information is collected. Entities may overlap and are not exclusive categories.
- Website Visitors: When you visit the Sites or contact us directly for information.
- Clients: When you contact us and have engaged in a client-attorney relationship with us.
Third Party Links and Websites. Our Sites may contain links to and from the
websites of third parties. If you follow a link to any of these websites, please
note that these websites have their own privacy policies and that we do not
accept any responsibility or liability for these policies. Please check these
policies before you submit any data to these websites.
2. What Types of Personal Information Do We Collect?
Information You Give Us. You may give us information by signing up for an
email newsletter, entering information through our online forms, visiting our
social media pages, submitting a resume online, or contacting us by phone,
email or on our Sites for information or customer service.
The categories of information include:
- Identifiers, such as real name, email address, postal address, online identifiers, Internet Protocol (“IP”) address, and other similar identifiers.
- Personal information under California Civil Code section 1798.80, such as name, telephone number, education, employment, employment history, credit card information, or bank account number.
- Characteristics of protected classifications under Federal or California law such as disability, marital status, or age.
- Professional or employment-related information, such as such as copies of your resume or CV and any other information required to verify your qualifications, for recruitment purposes.
- Education information, such as your education background and skills and any other information required to verify your qualifications, for recruitment purposes.
- Internet or other electronic network activity information, such as information regarding a consumer’s interaction with an Internet website, application, or advertisement.
- Inferences drawn from the above categories of information.
Information We Automatically Collect.
- Sites: Like many website operators, we collect information that your browser sends whenever you visit our Sites. This includes Log Data, such as your computer’s Internet Protocol (“IP”) address, domain name, browser type, browser version, the pages of our Sites that you visit, the time and date of your visit, the time spent on those pages and other statistics, and whether you reached our page via a social media or email campaign. This information may be collected via several technologies, including browser cookies, Flash cookies, web beacons, device identifiers, server logs, and other technologies. - Services: Some of our Services will collect IP addresses, connectivity details, and locations. This is used for access control and management.
Information We Collect From Third Parties. If you access our Sites through third parties (e.g., Meta or Google), or if you share content from our Sites to a third-party social media service, the third-party service will send us certain information about you if the third-party service and your account settings allow such sharing. The information we receive will depend on the policies and your account settings with the third-party service.
3. How Do We Use Personal Information?
We use your personal information as follows:
- To provide you with the services on our Sites;
- To share your website visitor activity, through website cookies, and with third-party marketing partners to market our services on our Sites and other websites that you may visit;

You will still continue to receive service-related messages (unless we have indicated otherwise).
4. How Do We Share Personal Information?
Affiliates and Service Providers. We share your information with our third-party service providers and any subcontractors as required to offer you our services. For example, we use Scorpion Legal Marketing for our website marketing tools and third-party vendors to process our customer payments. These service providers are under a duty of confidentiality to us. The service providers we use help us to:
- Run, operate and maintain our Sites through third-party platforms and software tools;
- Perform content moderation and crash analytics;
- Run email and text messaging campaigns;

- Provide payment attribution; and
- Provide technical and customer support.
Third Party Marketing and Advertising Cookies. With respect to website cookies, we share your information with third party marketing and advertising partners to provide tailored advertising on our Sites and other websites that you may visit, through cookies and similar technologies. Disclosures Required by Law. We may be required to disclose your personal information in response to lawful requests by public authorities, including to meet law enforcement requirements. We may be under a duty to disclose or share your personal information in order to comply with any legal obligation, to enforce or apply our terms and conditions and other agreements, to protect our rights, property, or safety, or the protect the rights, property, or safety of others. This includes exchanging information with other companies and organizations for the purposes of fraud protection.
5. How Do We Respond to ‘Do Not Track’ Signals?
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. We do not recognize or respond to browser-initiated DNT signals, as the Internet industry is currently still working toward defining exactly what DNT means, what it means to comply with DNT, and a common approach to responding to DNT.
6. Privacy Rights & Additional Disclosures for Certain U.S. Residents
Several jurisdictions grant state residents certain rights and disclosures. We provide the following information to further help you understand your potential privacy rights. If you would like to exercise any rights or inquire as to whether such rights are available to you, please contact us using the information in the “Contact Information” section, below.
Request for Information or Deletion. Residents of certain U.S. states have the right to know whether we are processing your personal information, and in some instances, you have the right to request that we disclose to you the categories listed below for the preceding 12 months. In responding to this right, we shall provide you:
- The categories of personal information we collect about you.
- The categories of sources from which your personal information is collected.
- The business or commercial purpose(s) for collecting, selling, sharing, or disclosing your personal information, and the categories of personal information disclosed for such purpose(s).
- The categories of third parties with whom we share your personal information.
- The categories of personal information we have sold, if any, about you and the categories of third parties to whom your personal information was sold, by category or categories of personal information for each third party to whom the personal information was sold.
- The specific pieces of personal information we have collected about you.
In addition, you may have the right to request we delete your personal information.
Request for Correction. Residents of certain U.S. states have the right to request the correction or rectification of inaccurate information in the resident’s personal information.
Request for Portable Data. Residents of certain U.S. states have the right to receive, in certain circumstances, a portable format of their personal information that allows the data to be transmitted to another entity.
Do Not Sell or Share My Personal Information. Residents of certain U.S. states have the right to opt out of the sale or sharing of the consumer’s personal information. We do not sell personal information. However, we do not sell your Personal Data, nor do we share your Personal Data to provide personalized or targeted advertising. Limiting the Use of Sensitive Personal Information. Residents of California have the right to direct us to use or disclose sensitive personal information only for providing goods or services, or as otherwise minimally permitted under applicable law. We do not use or disclose sensitive personal information for any purpose other than providing our goods and services to you, or as otherwise minimally permitted under applicable law.
Right to Equal Service & Price. You have the right to receive equal service and price, even if you exercise a privacy right.
Automated Processing & Profiling. Residents of certain U.S. states have the right to opt out of the processing of personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects concerning a consumer.
Verification Process for Exercising Rights. To protect our consumers’ privacy, we verify privacy rights requests to ensure that only you (or your authorized agent) can exercise rights pertaining to your personal information. As part of our verification process, we may request you to submit additional information.
If you are an authorized agent wishing to exercise rights on behalf of a state resident, please contact us using the information at the bottom of this Privacy Policy and provide us with a copy of the consumer’s written authorization designating you as their agent. We may need to verify your identity and place of residence before completing your rights request.
Appeal Process. In certain cases, we may decline to take action on your request as permitted by law. Should we decline your request, we may provide you with a written explanation of the reasons for our decision and an opportunity to appeal the decision.
If we deny your appeal, we may provide a written explanation of our decision with instructions on how to contact your local Attorney General or Department of Justice for further review, where permitted under certain U.S. state privacy laws.
Third Party’s Direct Marketing. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to third parties for the third parties’ direct marketing purposes. We do not disclose your personal information to third parties for the third parties’ direct marketing purposes.
7. Children’s Privacy
Our Sites are not directed at individuals under the age of 16. We do not knowingly collect personal information from children under 16, unless we have parental consent or as otherwise required by law. If you become aware that a child has provided us with personal information, please contact us using the information in the “Contact Information” section, below. If we become aware that a child under 16 has provided us with personal information, in violation of applicable law, we will take steps to delete such information.
8. Cookies
To make our Sites and Services work properly, and to provide tailored advertising, we sometimes place small data files called cookies on your device. We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information.
However, the transmission of information via the internet is not completely secure. Although we have established and maintain what we believe to be appropriate technical and organizational measures to protect the confidentiality, security, and integrity of your personal information, we cannot guarantee the security of your personal information transmitted to our Sites. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites.
We retain information from or about you for so long as necessary to fulfill the purposes outlined in this Privacy Policy. When the information is no longer necessary for these purposes, we delete it or keep it in a form that does not identify you, unless we are required by law to keep this information for a longer period. When determining the retention period, we take into account various criteria, such as the type of products and services requested by or provided to you, the nature and length of our relationship with you, possible re-enrollment with our products or services, the impact on the services we provide to you if we delete some information from or about you, mandatory retention periods provided by law and the statute of limitations.

12. Job Applicants
As part of any recruitment process, Bremer Whyte Brown & O’Meara, LLP, along with our affiliates, (“Bremer Whyte,” “Company,” “we,” “our,” “us”) collects and processes Personal Information relating to job applicants. The Company is committed to being transparent about how it collects and uses that data and to meeting its data protection obligations in the course of our hiring. This Privacy Policy explains how we collect, use, and share this information about you (“Personal Information”).

- What Personal Information Do We Collect?
We collect the following categories of Personal Information:
- Identifiers, such as name, parents’ surnames prior to marriage, alias, telephone number, personal and work email address, postal address, screennames, date of birth, signature, passport number, driver’s license or state identification card number.
- Personal information under California Civil Code section 1798.80, such as date of birth or signature.
- Financial information such as bank account numbers for expenses.
- Professional or employment related information, such as Curriculum Vitae/resumé, current and previous employment details, immigration status, or work authorizations.
- Education information, such as education background, university or school diplomas/certificates, and other educational achievements.
- Inferences such as job preferences or willingness to travel and/or relocate.
- Internet or other electronic network activity information, such as all documents, files, and information you send through our applicant portal.
We also collect the following categories of sensitive Personal Information:
- National identification numbers, such as social security number, driver’s license or state identification card number.
- Status, including citizen or immigration status or union membership.
Bremer Whyte may collect this Personal Information in a variety of ways. For example, data might be contained in application forms, CVs or resumes, obtained from your passport or other identity documents or collected through interviews or other forms of assessment.
We may also collect personal data about you from third parties, such as background checks and references supplied by former employers. We will seek information from third parties only once a job offer to you has been made and will inform you that we are doing so.
Data will be stored in a range of different places, including your application record, HR management systems, and other IT systems (including email).
In addition, where relevant to the recruitment process, including where necessary to accommodate any disability needs or to comply with some regulatory requirements, we may also have the need to process some characteristics of protected classifications. This may include:

- Ancestry, citizenship status, national origin (including languages used and proficiency)
- Religion, creed, political affiliations or activities

- How Do We Use Your Personal Information?
We will use your Personal Information for the following purposes:
- To process your application including to identify and contact you;
- To determine whether you have the professional skills, expertise and experience for the position applied for;
- If you are offered a position with us, to verify the Personal Information provided including your identity, address, right to work, employment history and academic background and other background screening purposes including, where allowed by law, criminal record checks, searches with a credit reference agency and sanctions screening checks;
- To provide you with information about future job vacancies, if you would like us to send you such notifications, which may include using data analytics to match your profile against vacant positions;
- To accommodate your disability needs;
- To detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; and,
- For compliance, disciplinary, legal and regulatory purposes.
We may collect additional categories of Personal Information for other business-related purposes and/or use Personal Information collected for additional purposes, upon prior written notice to you.
- Who Has Access to Personal Information?
Your Personal Information may be shared internally for the purposes of the recruitment process and for the other purposes described in this Privacy Policy. This includes members of the Bremer Whyte’s HR and recruitment team, interviewers involved in the recruitment process, managers in the business area with a vacancy, and IT staff if access to the data is necessary for the performance of their roles.
We will not share your Personal Information with third parties unless your application for employment is successful, and we make you an offer of employment. We will then share your Personal Information with former employers to obtain references for you, and employment background check providers to obtain necessary background checks.
In the event of a change of control or ownership of the Company or in the event all or party of the Company’s business is otherwise transferred to a third party, you are informed that your Personal Information as collected and maintained by the Company may be transferred to that third party, subject to applicable law.
- Security of Your Personal Data
We take the security of your data seriously. We have internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties. We employ security measures and technologies, such as password protection, encryption, physical locks, etc., to prevent unauthorized access and disclosure of your Personal Information.
- Retention of Your Personal Data
If your application for employment is unsuccessful, the organization will hold your data on file for 4 years after the end of the relevant recruitment process. At the end of that period, or upon your request, your data is deleted or destroyed.
If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your Human Resources file (electronic and paper-based) and retained during your employment.
Upon your separation of employment with the organization, your Personal Information shall be retained and destroyed according to our document retention policy and in compliance with applicable laws and regulations.
- Privacy Rights & Additional Disclosures for Californians
Californians have specific privacy rights for their Personal Information. As we have done above, businesses are required to inform members of the categories of Personal Information they collect and the purposes for which the categories will be used, at or before the point of collection.
